WELCOME
Oshwal Education and Relief Board is a non-profit organization whose objective is to promote the socio-economic development of Halari Visa Oshwals in the East African Region. We are assisted by various sub-committees among them the matrimonial committee. OERB collects data of potential singles within the community and creates a database to assist them in finding potential life partners.
We strive to create a community where our members feel comfortable and secure that their privacy is protected. We do that in the following ways:
INTRODUCTION
Oshwal Education and Relief Board with the address of P.O Box 49633-00100 Bulema Road, off 2nd Parklands, Nairobi, Kenya is a data controller under the Data Protection Act, 2019. Any reference to “OERB”, “we”, “us” or “our” within the terms of use refers to Oshwal Education and Relief Board. Together, the registered members may be referred to as the “parties” or separately as “party”.
We provide a matchmaking platform and related services including but not limited to, those related to events and any other in-person interactions between parties (collectively referred to as “the service”), subject to the following terms and conditions of use (as amended from time to time). By filling in the matrimonial registration form, attending an event or otherwise using the service in any other manner you agree to be bound by these Terms and Conditions of Use and Privacy Policy. We reserve the right to, in our sole discretion, change or modify the Terms of Use at any time. Each time we do so, we may indicate at the top of this page the date of the most recent version which will be available at https://matrimonials.oerb.org. Your continued use of the service after the date of any such changes become effective constitutes your acceptance of the new Terms and Conditions of Use.
REGISTRATION PROCESS
Interested community members are required to complete a registration form by providing certain information in order to sign up to the matchmaking platform. The registration form can be found at https://matrimonials.oerb.org.By registering you agree to receive emails or any form of communication in regards to the service. Further to this, you may be invited for an interview at our discretion.
If you choose to register, you agree to provide us with true, accurate, current and complete information about yourself as prompted and requested. This might include any documentary evidence or otherwise to support and verify the authenticity of the information submitted. Registration data and certain other information about you are governed by our Privacy Policy.
In addition to the disclaimers and limitations set forth below, OERB is not liable for any loss, injury or damage arising from your use of the service.
TERMS OF USE
Legally Binding Agreement: By accessing and interacting with the service offered by this platform you are in agreement to be bound by the terms of service contained in the terms and conditions outlined below. These terms apply to any registration form, email or communication between you and OERB.
Eligibility: You must be a Halari Visa Oshwal who is at least 21 years of age to sign up for the matchmaking platform. By filling the registration form, RSVPing to an event, attending an event or otherwise using the service, you represent and warrant that you are not a person who is barred from using the service.
Term and Termination: These terms of use will remain in full force and effect while you use the service. We may, in our sole discretion, at any time and for any good reason, suspend or terminate this agreement with or without prior notice. This agreement will terminate without prior notice from us, in the event that you fail to comply with any provision of the Terms and Conditions of Use. You may also stop using the service at any time you choose to. We will only keep your data for as long as necessary to fulfil our purpose of assisting those who want to find their potential life partners. You can email adminofficer@oerb.org or assistant-administrator@oerb.org at any time to access your data or have it deleted.
User Interactions, Meetings, Events: OERB is not responsible for the conduct of any of the parties or your experience at any in-person meeting, event or venue you are invited to or otherwise attend through the service. Your use of the service is at your own risk. You are solely responsible for your interactions with others through the service, this includes and is not limited to, in person interactions with those you meet through the platform and your attendance at any event or venue promoted, hosted or otherwise made available to you through the service. We make no representations or warranties as to the conduct of the registered parties, their fitness or compatibility. While we endeavor to ensure the privacy of all our participants, we have no involvement and disclaim all responsibility with respect to in person interactions. You should elect to disclose your personal and private information after careful deliberation. You agree to take all the necessary precautions in all interactions with other parties registered for the service.
User Information: You are solely responsible for the information that you share with other parties on the matchmaking platform including but not limited to, phone calls, messages, video chats, photographs or social media posts whether done publicly or privately. You represent and warrant that all the information that you submit upon filling the registration form is accurate and you will promptly ask us to update any information that subsequently becomes inaccurate, incomplete, misleading, or false.
You agree that we may access, preserve or disclose your information if required by the law or in good faith belief that it is reasonably necessary for the following purposes:
Third parties: The necessary information may be shared with a prospective match. This is subject to getting secondary permission from the parties. You agree that you must evaluate and bear all the risks associated with the use of the matchmaking platform including any reliance on the accuracy or completeness of the information provided by parties and disclosure of personal information during interactions with prospective matches. We will have the right but not the obligation to remove or verify any of the data collected that is deemed as incorrect.
Communication: By signing up for the service, including in submitting the registration form, you agree that we may email or call you in regards to the service. You may reach out to us at any time at adminofficer@oerb.org to change your change your contact details.
Disclaimers: You acknowledge and agree that neither OERB nor its committee members, employees, agents or affiliates are responsible for, and shall under no circumstances have, any liability directly or indirectly, for any loss or damage, whether in an action of contract, negligence or tort, including personal injury or death, as a result of or alleged result of the use of the matchmaking platform. We reserve the right to make additions, deletions or modifications to the contents of the service at any given time without prior notice.
OERB provides the service on an “as is” and “as available” basis and grants no warranties or representations of any kind, whether express, implied or otherwise with respect to the service (including the contents herein). We only collect the information provided by parties and as such make no warranty or representation as to the accuracy or reliability of any information provided through our services. Any information given and shared is done at your own discretion and risk, and you will solely be responsible for and waive any and all claims and causes of action with respect to your engagement and interaction with other parties. If you do not accept this limitation of liability, you are not authorized to register for the service.
Limitation on Liability: Any information obtained through the use of the service is accessed at your own discretion and risk. To the fullest extent applicable, in no event will OERB, its employees, board and committee members, agents or affiliates be liable to you or any third party for any direct, indirect, exemplary, special or punitive damages including without limitation loss of good will or exchange of information between the parties.
Dispute Resolution: In resolving any dispute or claim arising out of or relating to these Terms and Conditions of Use (including alleged breach thereof) or the service the initial forum will be through mediation and where that fails, the dispute will be referred to arbitration in accordance with the Arbitration Act or any statutory modifications thereof for the time being in force.
Governing Law: The Terms and Conditions of Use and any dispute arising from the service shall be governed by the laws of Kenya.
Indemnification: You agree to indemnify and hold OERB, its committee, employees, agents or affiliates harmless from any loss, liability, claim or demand including advocate fees, due to or arising out of:
We reserve the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will fully cooperate with OERB.
Reviews: You are welcome to give feedback, comments or suggestions with respect to the service.
Severability: These Terms and Conditions of Use and the Privacy Policy, comprise the entire agreement between you and OERB regarding the use of the service. If any provision herein is held invalid or unenforceable, the other clauses shall continue in full force and effect. Our failure to exercise or enforce any right or provision of the terms of use does not constitute a waiver of the said provision or right.
