OSHWAL EDUCATION AND RELIEF BOARD-PRIVACY POLICY

Oshwal Education and Relief Board (“OERB”, “we”, “us” or “our”) is committed to maintaining safety, transparency, and trust within the Halari Visa Oshwal community. We understand that the privacy and confidentiality of our members who register for the matchmaking platform is of utmost importance. We reassure you that your privacy is a top priority for us. To that extent, the Privacy Policy set forth (the “Policy”) is a reflection of our commitment to protecting your privacy and personal information. This privacy policy is incorporated into and is a part of our Terms and Conditions of Use. The purpose of this policy is:
- How we handle and use your personal data;
- The third parties we share your personal data with; and
- Your rights in relation to your personal data.
We have attempted to describe the policy in plain language limiting legal and technical jargon where possible. By filling in the registration form, RSVPing, and/ or attending events that are organized, promoted, and advertised by us, you are agreeing to be bound by the terms described herein. This privacy policy applies to all use by you of the matchmaking platform. We encourage you to read this policy and our terms of use carefully and contact us in case of any questions at adminofficer@oerb.org or assistant-administrator@oerb.org.
We will occasionally update this policy to reflect the changes in the law or our data collection and use practices. When we make changes, we will revise the “updated” date at the top of this policy which will be posted at https://matrimonials.oerb.org. We encourage you to regularly check for the most recent version, as your continued use of the service following the changes will reflect on your consent and acceptance. If you do not consent to these changes, you may terminate your registration at any point as you choose.
COLLECTING INFORMATION
Information you provide in connection with registration: In order to join the matchmaking process, you will be required to fill in a registration form. You will be required to provide your contact details, the names of your parents and siblings, occupation and field of study, and physical and residential address among other things. Upon doing so, you authorize us to access your personal information. This information is used to verify your eligibility for the service, to match you with potential partners, and to make referrals to potential partners also registered as/when necessary and with your written consent. We will also use your information to carry out communication or surveys or for legal purposes. In addition, we may collect and store any personal information you provide in connection with your registration while using the service which may include; your name, atak, gaam, date of birth, age, hobbies, and gender. You are also required to provide us with a copy of your identification and a full photo of yourself.
Some of the information you provide may be considered “sensitive” as described under the Data Protection Act, 2019. By choosing to provide this information, you consent to our processing of it.
You may change or update your information by contacting us at any time.
Information Other Users Provide: In addition to the information you provide to us, other registered parties or potential partners you interact with during the matchmaking may provide information about you from your engagements or interactions if, for instance, they contact us about you.
Data Controller Information: OERB is responsible for the maintenance and safeguarding of your information under this privacy policy.
SHARING AND USE OF INFORMATION
The personal information you provide us with is only used for the purpose of the service. We do not disclose your information to any third party without your consent, provided however that we use the information internally.
Information shared with other users: When you register as a user, we will match you with other registered members whom we think are suitable. Should both parties consent, then we will share the necessary information to set them up. If you choose to engage in a conversation and share further information between yourselves, we are not involved or part of the interaction. If you are not registered through the online form but RSVP or attend an event, we will collect your information and register you for the service.
Use of information by OERB: We may use the information we collect among other things to, to create and manage the matchmaking database, manage events and RSVP lists, communicate with you, receive feedback on improving the service, and enforce or exercise any rights under our Terms and Conditions of Use.
Other situations: We may disclose your information in connection with; legal matters and to ensure legal compliance, a consent or request from you that we do so.
Legal Basis for processing your information: We rely on the fact that we process your information to perform the contract you have with us by agreeing to be bound by the terms and conditions of use. From time to time, we may ask for your consent to use your information for certain specific reasons. You may withdraw your consent at any time by reaching out to us.
KEEPING YOUR INFORMATION SECURE
Security measures, no liability: We take safeguarding of your information seriously and have implemented measures to secure it including but not limited to technical measures and execution of non-disclosure agreements. However, we have no control over the conversations parties may have and interactions during in-person events. We have no liability towards you or any third party arising out of omission or misuse of personal information willingly shared.
Retaining your information: We keep your personal information only as long as we need it for the service. Once you find a successful match, we will delete your data within a period of three months. You can also ask us to delete your information as and when you choose to stop using the service.
Communication: By using the service in any capacity including RSVPing for any event, or attending an event, you agree to receive correspondence from us regarding the event update or upcoming events and features which correspondence is based on information you have provided in the registration form.
Automated decision-making and profiling: This refers to a decision made by automated means without any human involvement. We do not engage in automated decision-making or profiling.
Your Rights: You have the following rights with respect to the personal data we process-
- The right to withdraw consent where that is the basis for processing;
- The right to be informed of the use;
- The right to access;
- The right to rectify any information that is inaccurate, outdated, incomplete, or misleading;
- The right to erasure;
- The right to restrict or object processing of all or part of their data;
- Rights in relation to automated decision-making and profiling;
- Right to express your views on the match provided;
- Right to contest the match provided;
- The right to data portability; and
- Where a person authorized by you seeks to exercise your rights on your behalf, they should take into consideration your best interests. Where there is doubt, we shall halt the request until evidence is adduced.
For your protection, we may ask you to provide proof of identity before we can answer the following requests. We may not be able to accommodate certain requests to object processing of your personal information, where such requests may not allow us to provide the service to you. For example, you cannot register for the service if you omit your date of birth.
Age policy: We restrict our service to Halari Visa Oshwals who are 21 years of age and older. We will only consider the registration and acceptance of those who are at least 21, however, we are not liable should someone misrepresent their age in their registration. Should we become aware of anyone who is not of the requisite age, we will immediately remove them from our database and bar them from accessing the service.
Dispute Resolution: In resolving any dispute or claim arising out of or relating to the policy (including alleged breach thereof) or the service the initial forum will be through mediation and where that fails, the dispute will be referred to arbitration in accordance with the Arbitration Act or any statutory modifications thereof for the time being in force.
Governing Law: The Terms and Conditions of Use and any dispute arising from the service shall be governed by the laws of Kenya.
